General Terms and Conditions
NextLevel Tribe
These terms and conditions apply when you visit our website, place an order via our webshop, or contact us by any other means.
Article 1. Definitions

NextLevel Tribe: registered with the Chamber of Commerce under registration number 84963247, located in Utrecht and operating under the name NextLevel Tribe.

Webshop: NextLevel Tribe is a webshop aimed at selling products. Accessible via thenextleveltribe.com and all associated (sub)domains.

Customer: understood as the natural or legal person, whether acting in the performance of their profession or business or not, who uses (and/or has registered on the website) the services of NextLevel Tribe.

Agreement: any arrangement or agreement between NextLevel Tribe and the customer, of which the general terms and conditions form an integral part. The legal relationship between NextLevel Tribe and the customer, in the broadest sense.

General Terms and Conditions: in these, ‘services’ shall mean all products and services provided by NextLevel Tribe and/or by third parties engaged by it to the customer, as well as all other work performed by NextLevel Tribe for the customer, of any nature, carried out in the context of an assignment, including work not performed at the explicit request of the customer. Article 2. Applicability of the General Terms and Conditions

The general terms and conditions apply to all agreements (including all offers) concluded between the customer and NextLevel Tribe where NextLevel Tribe offers services or delivers products.

Deviations from the general terms and conditions are only valid if expressly and in writing agreed with NextLevel Tribe.

Applicability of purchase or other conditions of the customer is expressly rejected, unless expressly and in writing otherwise agreed.

The general terms and conditions also apply to additional or modified assignments from the customer.

If a provision in these general terms and conditions is null and void, this does not affect the validity of the remaining general terms and conditions. In such a case, the parties will establish a new provision, which will give effect to the intention of the original provision as much as legally possible.

Situations not covered in these general terms and conditions should be assessed in the spirit of these general terms and conditions.

If there are ambiguities in the interpretation or content of one or more provisions of our terms, they shall be interpreted in the spirit of these general terms and conditions.

Article 3. The Agreement

NextLevel Tribe does not deliver when the customer has provided an address in a country where NextLevel Tribe does not deliver.
-
Customers may also place orders on the website. The agreement is concluded by placing an order and fulfilling the conditions set by NextLevel Tribe.
-
If NextLevel Tribe sends a confirmation to the customer, this is decisive for the content and interpretation of the agreement, subject to obvious errors. NextLevel Tribe is not bound by its offer if the customer can reasonably understand that the offer or part of it contains an obvious mistake.

NextLevel Tribe may consider not entering into an agreement if there is suspicion of fraud/misuse/deception, including if a previous order was not collected.

The customer is responsible for providing accurate information. If it appears that incorrect information was provided at the time of acceptance or otherwise, NextLevel Tribe has the right to fulfill its obligation only after the correct information is received. NextLevel Tribe also has the right to refuse an order on suspicion of misuse/fraud (see also paragraph 4 of this article).

Within legal limits, NextLevel Tribe may conduct an investigation to determine whether the customer can meet their payment obligations and consider all facts and factors relevant for responsibly entering into the agreement. If, based on this investigation, NextLevel Tribe has good reason not to enter into the agreement, it is entitled to refuse the order or request. Special conditions, such as advance payment, may apply to the execution.

NextLevel Tribe reserves the right to update, amend, or replace the general terms and conditions at any time. The change/update will be announced on the NextLevel Tribe website. Customers are expected to consult the website and check for the most recent version of the general terms and conditions (particularly in the case of a purchase).

Notes or feedback from the customer regarding the agreement/purchase/offer of NextLevel Tribe do not form part of the agreement unless confirmed in writing by NextLevel Tribe.

An assignment from the customer for which no prior written offer has been made requires written acceptance by NextLevel Tribe.

The customer ensures that NextLevel Tribe can perform its services in a timely and proper manner. If the customer fails to comply, they are liable for the resulting damages.

Article 4. Amendment of the Agreement

If, during the execution of the agreement, it becomes necessary to amend or supplement it for proper execution, NextLevel Tribe and the customer will timely consult to adjust the agreement.

If the agreement is amended, including a supplement, it constitutes an additional assignment. A separate agreement on remuneration for this additional assignment shall be made in advance. Without a separate offer, the original terms apply, and extra services are charged at the usual rate.

Failure to immediately execute the amended agreement does not constitute a breach by NextLevel Tribe and does not give the customer the right to terminate or dissolve the agreement.

Amendments to the originally concluded agreement between NextLevel Tribe and the customer are only valid once accepted in writing by both parties.

Article 5. Execution of Agreement and Delivery/Shipping

Once the order is received by NextLevel Tribe, it will send the products as soon as possible (see website), taking paragraph 3 of this article into account.

NextLevel Tribe considers the address provided by the customer as the place of delivery.
-
NextLevel Tribe strives to deliver accepted orders in a timely manner. If delivery does not occur within a reasonable period, the customer has the right to dissolve the agreement without entitlement to additional compensation. NextLevel Tribe may choose various delivery methods. All delivery times are indicative. Customers cannot derive rights from any stated delivery times. Exceeding a delivery time does not entitle the customer to compensation.

NextLevel Tribe has the right to engage third parties in fulfilling obligations arising from the agreement.

NextLevel Tribe determines the method of transport and packaging. Delivery may be via PostNL or another carrier, or personally. NextLevel Tribe is free in choosing the shipping method, which may change. Once NextLevel Tribe hands over the package to the carrier, it no longer influences delivery time.

NextLevel Tribe informs the customer if delivery cannot occur within the agreed period. In consultation, the customer may agree to a new delivery date or dissolve the agreement without cost.

Once products are delivered to the specified address, the risk passes to the customer. Risk may transfer earlier if explicitly agreed. If the customer collects the products, risk transfers upon handover.

If delivery is not collected or refused, return and storage costs, as well as risk of damage or loss, are fully at the customer’s expense.

NextLevel Tribe recommends inspecting delivered products immediately (within 14 days of delivery) and reporting defects with clear photos and description via the return form on the website.

Uncollected Parcels, Refused Deliveries and Neighbour Delivery:
A. Uncollected parcels
If a parcel is not collected from the pickup point within the carrier’s holding period and is automatically returned to us, this is considered a customer‑initiated return. The costs for the original shipment and the return shipment will be deducted from the refund.
B. Refused deliveries
If the customer refuses the parcel at the door, this is also treated as a customer‑initiated return. The costs for the original shipment and the return shipment will be deducted from the refund.
C. Delivery to neighbours
Carriers may deliver parcels to neighbours unless the customer has explicitly selected a “do not deliver to neighbours” option. If neighbour delivery is allowed, the parcel is considered successfully delivered. If the customer selected “do not deliver to neighbours” and the carrier still delivers to neighbours, this is a carrier error and will be handled accordingly.
D. Refund of shipping costs
If the customer selected a shipping method that is more expensive than our standard shipping option, only the cost of the standard shipping method will be refunded, as permitted under EU consumer law.

Article 6. Suspension, Termination, and Early Cancellation of the Agreement

NextLevel Tribe is entitled to suspend performance of obligations or terminate the agreement if the customer fails to comply with the obligations under the agreement, does not fully comply, or does not comply on time, or if NextLevel Tribe has good reason to fear that the customer will fail in these obligations. NextLevel Tribe may, but is not obliged to, send a written notice of default giving the customer a reasonable period to fulfill their obligations, and if performance does not occur within this period, NextLevel Tribe may act accordingly.

NextLevel Tribe is also entitled to terminate the agreement under the same conditions if circumstances arise making performance of the agreement impossible or unreasonable to expect the agreement to continue unchanged.

If the customer fails to fulfill their obligations, such non-performance justifies termination, and the customer is in default, NextLevel Tribe is entitled to immediately terminate the agreement via a written statement, and the customer is liable for compensation or indemnification due to breach.
Article 7. Right of Withdrawal

The customer has the right to cancel a distance contract within 14 (fourteen) days free of charge and without giving any reason (right of withdrawal). This right of withdrawal applies only to customers residing within the European Union. Customers outside the EU have no right of withdrawal unless otherwise agreed in writing with NextLevel Tribe.

For agreements concerning services, the withdrawal period starts on the day the agreement is concluded.

The customer cannot cancel the agreement if NextLevel Tribe has fully delivered the services within the 14-day cooling-off period. By concluding the agreement, the customer consents to this and waives the right of withdrawal.

The customer retains the right of withdrawal if the delivery of services, at the customer’s request, occurs partially within the 14-day period. The customer must pay for services already delivered.

For agreements regarding products, the withdrawal period begins for the customer, or a third party designated by the customer (not the carrier), on the day they: receive the product, receive the last product if multiple products are ordered separately, or receive the first product in recurring delivery agreements.

If the customer exercises the right of withdrawal within the period mentioned in paragraph 1, NextLevel Tribe will refund the full amount paid by the customer within 14 (fourteen) days of receipt of the returned product. Unless NextLevel Tribe offers to collect the product, it may wait with repayment until the returned product is received.

Defects or inaccuracies discovered upon inspection, considering reasonableness and fairness, must be reported in writing within 14 (fourteen) days of product receipt via the return form to NextLevel Tribe.

Products made according to customer specifications (e.g., custom-made) or products whose seal has been broken for hygiene or health reasons are excluded from the right of withdrawal.

The customer may return the product via a self-chosen postal service. Return shipping costs are borne by the customer. The customer bears the return shipping costs and risk of the returned product. NextLevel Tribe reserves the right to refuse insufficiently or non-franked returns.

A model withdrawal form is available as a PDF . The customer may use this form to exercise the right of withdrawal.

During the withdrawal period, the customer must handle the received product and packaging with care. The packaging may only be opened to the extent necessary to inspect the product. The inspection should not exceed what is possible in a physical store. If the product is returned and opening the packaging is not necessary, the customer should refrain from opening it. Returned products must:
1) Be undamaged, unworn, unwashed, and with original packaging and tags.
2)Be free of food stains, makeup, body odors, pet hair, cigarette smells, etc.
3)Not have attempted repairs. -
The customer is only liable for a reduction in value if caused by inspection actions exceeding the procedure in paragraph 11.

To return an order, the customer may fill in the return form or indicate unequivocally by other means that they wish to cancel the distance agreement.

If the customer submits the form electronically or notifies NextLevel Tribe electronically of withdrawal, NextLevel Tribe confirms receipt.
Article 8. Cancellation

- Cancellation is no longer possible once an email has been sent indicating that the product has been shipped, with the time of receipt of this message by the customer being decisive.
Article 9. Costs, Fees, and Payment

All amounts on the website are in euros and include VAT, unless stated otherwise.

All offers on the website are non-binding and valid while supplies last. No rights can be derived from them.
-
Customers purchasing products outside promotional periods are not entitled to previous promotions.
-
Discount codes may be invalidated in cases of suspected abuse/fraud or other justified reasons.
-
NextLevel Tribe has the right to correct obvious typographical errors in pricing.
-
Customers must pay NextLevel Tribe via the payment methods indicated in the order process or on the website. NextLevel Tribe is free to choose payment methods, which may change over time.

Gift cards and vouchers are accepted as payment. Gift cards expire one year after issue and cannot be redeemed for cash. Any remaining balance from returns will be reloaded onto the gift card. Gift cards cannot be purchased with discounts or codes.

Customers are advised to retain gift cards/vouchers in case the product does not meet expectations. Lost or stolen gift cards/vouchers cannot be replaced.

Current shipping costs for orders within the Netherlands are listed on the website.

All invoices must be paid within 14 days, unless otherwise agreed.
-
The customer must promptly inform NextLevel Tribe of any inaccuracies in the provided payment details.
-
Late payment automatically results in default without further notice. The customer owes statutory interest from the moment of default until full payment.
-
If NextLevel Tribe initiates legal collection of unpaid invoices, the customer is liable for reasonable judicial and extrajudicial costs in addition to the principal and interest. These costs are determined according to applicable regulations on extrajudicial collection costs.

Article 10. Retention of Title / Intellectual Property

All intellectual property rights, including but not limited to trademark rights, logos, and copyrights on the website and materials provided by NextLevel Tribe to the customer, remain solely with NextLevel Tribe.

The customer shall indemnify NextLevel Tribe against any claims asserting that making available, using, modifying, installing, or incorporating these materials infringes any third-party rights.

All delivered products remain the property of NextLevel Tribe until full payment has been received.
-
All risk of quality loss or damage, in the case of paragraph 3, passes to the customer upon receipt of the product.

Article 11. Force Majeure

Force majeure is defined as all external causes beyond the control of NextLevel Tribe, making timely, full, or correct performance of the agreement impossible.
-
Force majeure includes, but is not limited to: third-party non-performance, abnormal weather conditions, interruptions in water or energy supply, strikes, serious system failures at NextLevel Tribe, fire, flooding, natural disasters, riots, war, or domestic unrest.

In case of force majeure, performance of the agreement is suspended as long as the force majeure persists.

If force majeure lasts longer than one month, both parties may terminate the agreement without judicial intervention. In such a case, NextLevel Tribe will refund any amounts paid, minus any costs incurred in connection with the agreement. The customer has no right to compensation.

Article 12. Warranty

Warranty applies only to customers not acting in the exercise of their profession or business.

NextLevel Tribe guarantees that the products comply with the agreement, reasonable requirements of quality and usability, and applicable statutory regulations and government standards at the time of the agreement.

If the customer detects a deviation from the delivered product that does not comply with the agreement, they must notify NextLevel Tribe within a reasonable period from delivery.
-
Defects must be reported in writing to NextLevel Tribe via the return form.
-
If NextLevel Tribe considers the complaint valid, the relevant products will be repaired, replaced, or reimbursed in consultation with the customer. Maximum reimbursement equals the price paid by the customer for the product.

Warranty does not cover normal wear and tear, intentional damage, damage from not following care labels, modifications, negligence (water, drop, or impact damage), or misuse by the customer, nor when the defect’s cause cannot be determined. No warranty is provided for zippers or buttons.

Warranty also does not apply if products have been modified or maintained by third parties.

Article 13. Confidentiality of Personal Data

- NextLevel Tribe processes customer personal data in accordance with the privacy and cookie statement published on the website.
Article 14. Registration / Account

Customers may register an account on the website for optimal use.
-
During registration, the customer chooses a username and password for logging in. The customer is responsible for selecting a secure password.
-
NextLevel Tribe treats login details (username and password) as strictly confidential. It is not liable for misuse of login credentials and assumes the person logging in is the registered customer. All activity via the account is the customer’s responsibility and risk.

If the customer suspects or knows that login credentials have been compromised, they must immediately change the password and/or notify NextLevel Tribe. Appropriate measures may then be taken.

Article 15. Complaints Procedure

Customers with complaints about a product (see Article 12 on warranty and conformity) or other aspects of NextLevel Tribe’s service can submit a complaint via the website contact form.

Complaints will be processed within five (5) working days if reasonably possible. If a substantive response is not yet possible, NextLevel Tribe will confirm receipt within 15 working days and provide an estimated timeframe for a substantive response.

NextLevel Tribe takes all justified complaints seriously and aims to resolve them satisfactorily. Customers are encouraged to contact NextLevel Tribe first. If dissatisfied with the resolution, complaints may be submitted via the European Online Dispute Resolution platform.

Paragraph 3 does not affect customer obligations arising from the agreement or these terms.

Article 16. Applicable Law and Competent Court

Dutch law governs the legal relationship between NextLevel Tribe and the customer. Disputes may be submitted to the competent Dutch court in the district where NextLevel Tribe is established, unless mandatory law dictates otherwise.

Disputes arising from the agreement will be submitted to the competent Dutch court in the district where NextLevel Tribe is established.

Article 17. Final Provisions

NextLevel Tribe can be contacted via the website: thenextleveltribe.com.

In all communication, the sender’s identity and integrity must be verifiable.

The website content is carefully compiled. Prices and other information on the website and in other materials are subject to typographical or programming errors. No liability is accepted for consequences.

NextLevel Tribe is not liable for color or light deviations due to screen settings/quality. This does not affect consumer rights in case of non-conformity.
-
NextLevel Tribe is never responsible for consequential damages.
-
NextLevel Tribe is not liable for damage to vehicles or other objects caused by improper use of the products.
